Man accused of 2022 murder of Faith Rogers has all charges dismissed

Anthony Michael Migliaccio set free by Juneau judge who cites improper evidence

This is a developing story.


A man accused of murdering a Juneau woman whose body was found on a hiking trail in 2022 had all charges dismissed against him Monday, according to court records and a published report.


The body of Faith Rogers, 55, was found on the Kaxdigoowu Héen Dei (Brotherhood Bridge Trail) on Sept. 21, 2022. Anthony Michael Migliaccio, 36, was arrested about two months later on a first-degree murder warrant.


However, the first-degree murder charge was dismissed in court soon thereafter. Juneau Superior Court Judge Marianna Carpeneti on Monday dismissed the remaining three counts of murder and one count of manslaughter against Migliaccio.


Specifics of the dismissal were not immediately available Monday evening. However, the Alaska Court System’s online database shows four motions were deemed "moot" on June 20. Those motions included "Motion to Suppress Fruits of Illegal Arrest and Request for Evidentiary Hearing; Notice of Conventionally Filed Exhibit," "Motion to Suppress and Destroy Confidential Mental Health Records," "Motion to Suppress Fruits of Illegal Detention and Request for Evidentiary Hearing," and "Motion to Suppress Statements Protected by ‘Communications to Clergymen’ Privilege, Request for Evidentiary Hearing and Notice of Confidentially Filed Exhibit."


Carpeneti ruled that Migliaccio can be released from Goose Creek Correctional Center in Wasilla as of Monday, according to KTOO, which first reported this story. District Attorney Whitney Bostick, in a statement Monday to KTOO, said the state will not refile charges against Migliaccio.


“We fully recognize the weight of this decision and the impact it will have on the victim’s family, who continue to mourn the loss of their loved one — a victim of a tragic and senseless act,” the statement notes. “However our duty as prosecutors is to move forward with charges only when the evidence is beyond a reasonable doubt.”
